Article 1 (Purpose)
Standard Terms No. 10023
The purpose of these terms and conditions is to set forth the rights, obligations, and responsibilities of the Cyber Mall and its users concerning the use of internet-related services (hereinafter referred to as "Services") provided by the Cyber Mall operated by Research Factory Co., Ltd. (hereinafter referred to as the "Mall"), an electronic commerce operator.
※ These terms and conditions shall also apply to electronic transactions using PC communication, etc., as long as they do not contradict their nature.
Article 2 (Definitions)
1. The "Mall" refers to the virtual business place set up by Research Factory Co., Ltd., using computers and other information and communication equipment to facilitate transactions of goods or services with users. The term also refers to the business operator managing the Cyber Mall.
2. The "User" refers to any individual accessing the "Mall" to receive services provided by the "Mall" under these terms and conditions, including both members and non-members.
3. "Member" refers to an individual who provides personal information to register as a member of the "Mall" and continuously receives information and services from the "Mall."
4. "Non-member" refers to an individual who uses the services provided by the "Mall" without registering as a member.
Article 3 (Specification, Explanation, and Amendment of Terms)
1. The "Mall" shall display these terms and conditions, along with details such as the company name, representative's name, business location (including the address for handling consumer complaints), telephone number, fax number, email address, business registration number, e-commerce permit number, and personal information protection officer, on the main page of its website for easy access by users. However, the content of the terms and conditions may be accessible through a connected page.
2. Before a user agrees to these terms, the "Mall" must provide a separate pop-up or linked screen for users to confirm key terms, such as withdrawal of subscription, delivery responsibilities, and refund conditions.
3. The "Mall" may revise these terms and conditions within the boundaries of the applicable laws, such as the Consumer Protection Act, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization, the Door-to-Door Sales Act, and other related laws.
4. In the event of a revision, the "Mall" shall specify the effective date and reason for amendment and post the revised and current terms on the main page of the "Mall" for a period of at least seven days before the effective date. If the revision is unfavorable to users, a minimum grace period of 30 days shall be provided, during which the "Mall" will clearly indicate the changes for user comprehension.
5. Revisions to these terms apply only to contracts formed after the effective date of the revised terms. Contracts formed earlier shall remain subject to the terms applicable at the time unless the user requests the application of the revised terms within the notice period, and the "Mall" consents to such application.
6. Matters not defined in these terms and their interpretation shall comply with applicable laws, such as the Consumer Protection Act, the Act on the Regulation of Terms and Conditions, and the guidelines for consumer protection in electronic commerce specified by the Fair Trade Commission.
Article 4 (Provision and Modification of Services)
1. The "Mall" shall perform the following tasks:
① Provision of information on goods or services and facilitation of purchase agreements
② Delivery of goods or services under purchase agreements
③ Other tasks determined by the "Mall"
2. The "Mall" may modify the content of goods or services provided under future contracts due to reasons such as sold-out inventory or changes in technical specifications. Any such modifications shall be immediately announced at the location where the current goods or service information is posted.
3. In cases where the "Mall" modifies the content of goods or services due to sold-out inventory or technical changes after a contract is formed, it shall immediately notify the user via the address provided.
4. The "Mall" shall compensate users for any damage resulting from changes mentioned above unless the "Mall" proves that it was not intentional or negligent.
5. All products offered on the Mall are custom digital illustrations delivered online. No physical goods are provided.
Article 5 (Suspension of Services)
1. The "Mall" may temporarily suspend services due to reasons such as maintenance, replacement, breakdown of computer or communication equipment, or disruptions in communication.
2. The "Mall" shall compensate users or third parties for damages resulting from temporary suspension unless it proves that there was no intentional fault or negligence.
3. If the "Mall" is unable to provide services due to business transitions, closure, or mergers, it shall notify users as outlined in Article 8 and compensate them as initially promised. If no compensation standards have been communicated, the "Mall" shall compensate users with cash or equivalent value of their mileage or points.
Article 6 (Membership Registration)
1. Users may apply for membership by completing the registration form provided by the "Mall" and expressing their agreement to these terms.
2. The "Mall" shall register users as members unless they fall under any of the following cases:
① The applicant has previously lost membership under Article 7, Paragraph 3. However, exceptions apply if three years have elapsed since the loss of membership and the "Mall" consents to re-registration.
② The application contains false information, omissions, or errors.
③ Technical issues make registration infeasible.
3. Membership shall be deemed effective upon the "Mall's" acceptance of the application.
4. Members must notify the "Mall" of any changes to their registered information without delay via email or other means.
Article 7 (Membership Withdrawal and Disqualification)
1. Members may request to withdraw from membership at any time, and the "Mall" shall process the withdrawal immediately.
2. The "Mall" may restrict or suspend membership under the following circumstances:
① False information was provided during the registration process.
② Payment obligations related to goods or services purchased through the "Mall" are not fulfilled.
③ Disruption of other users’ access to the "Mall" or actions threatening electronic commerce order.
④ Conduct violating laws or these terms and conditions.
3. If the same violation occurs twice or the issue is not resolved within 30 days, the "Mall" may revoke membership.
4. If membership is revoked, the "Mall" shall notify the user, granting at least 30 days for the user to provide an explanation before finalizing the revocation.
Article 8 (Notification to Members)
1. The "Mall" may notify members via the email address specified during registration.
2. For notifications to an unspecified large number of members, the "Mall" may post an announcement on its bulletin board for at least seven days instead of individual notifications. However, matters significantly affecting individual transactions shall be communicated separately.
Article 9 (Purchase Application)
The "Mall" shall facilitate purchase applications through methods similar to the following. For members, Subparagraphs 2 to 4 may be excluded:
1. Search and selection of goods or services
2. Entry of personal information such as name, address, phone number, and email address (or mobile number)
3. Confirmation of the terms, withdrawal rights, shipping fees, and other cost responsibilities
4. Expression of agreement to these terms (e.g., by clicking a button)
5. Submission and confirmation of the purchase application or consent to the "Mall’s" confirmation
6. Selection of payment methods
Article 10 (Copyright)
For freelance creators (sellers), contracts are based on conditional copyright transfer. Purchased images are prohibited from being resold or reprocessed.
Purchased images are restricted to academic use only and cannot be used for commercial purposes. For commercial use, buyers must consult and negotiate with the seller.
Article 11 (Formation of Contract)
The "Mall" may refuse to accept a purchase request as outlined in Article 9 under the following conditions. However, in cases where contracts are made with minors, the "Mall" must notify that the contract may be canceled by the minor or their legal representative if consent from the legal representative is not obtained:
If the application contains false information, omissions, or errors.
If a minor attempts to purchase goods or services prohibited under the Youth Protection Act, such as tobacco or alcohol.
If accepting the purchase request significantly hinders the "Mall's" technical capabilities.
The contract is considered established when the "Mall's" acceptance reaches the user in the form of an order confirmation notification, as per Article 12(1).
The "Mall's" declaration of acceptance must include information about the user's purchase request, the availability of goods, and details about modifications or cancellations of the purchase request.
Article 12 (Payment Methods)
Payment for goods or services purchased through the "Mall" can be made using any of the following methods, provided that the "Mall" does not impose additional fees for using these methods:
Various account transfers, such as phone banking, internet banking, or email banking.
Payments via prepaid cards, debit cards, or credit cards.
Online bank deposits.
Payments using electronic currency.
Payment upon receipt.
Payments using points or mileage provided by the "Mall."
Payments with gift certificates contracted or approved by the "Mall."
Payments through other electronic payment methods.
All payments are securely processed by Paddle, our authorized reseller and Merchant of Record.
Paddle handles billing, invoicing, and payment-related inquiries on behalf of Research Factory Co., Ltd.

Article 13 (Order Confirmation Notification, Change, and Cancellation of Purchase Request)
The "Mall" shall send an order confirmation notification to the user upon receiving a purchase request.
Users who receive the confirmation notification can immediately request changes or cancellations if there is any inconsistency with their intentions. If requested before shipment, the "Mall" must promptly comply with such requests. However, if payment has already been made, the provisions in Article 15 regarding withdrawal of subscription shall apply.
Article 14 (Supply of Goods)
Unless otherwise agreed upon, the "Mall" shall take necessary measures such as order production or packaging to deliver goods within seven days from the date of the user’s order. If the "Mall" has already received all or part of the payment, such measures must be taken within two business days from the date of receipt. During this process, the "Mall" must enable users to check the status and progress of their order.
The "Mall" shall specify the delivery methods, who bears the delivery costs, and the estimated delivery time. If the agreed delivery period is exceeded, the "Mall" shall compensate the user for any damages caused, unless the "Mall" proves there was no intent or negligence.

Article 15 (Refunds)
If the "Mall" cannot deliver or provide the purchased goods due to unavailability, it shall notify the user immediately. If payment has already been made, the "Mall" must refund the payment or take necessary measures to ensure a refund within two business days from the date of notification.
Article 16 (Withdrawal of Subscription, etc.)
1. A user who has entered into a purchase contract for goods or services with the "Mall" may withdraw their subscription within seven days from the date they receive confirmation of receipt.
2. However, if the user has received the goods or services, they may not return or exchange them in the following cases:
① When the goods are lost or damaged due to reasons attributable to the user (except when the packaging is damaged to confirm the contents of the goods).
② When the value of the goods has significantly decreased due to the user's use or partial consumption.
③ When the value of the goods has significantly decreased to the extent that resale is difficult due to the passage of time.
④ When the packaging of goods that can be reproduced with the same performance is damaged.
3. In cases falling under items 2 to 4 of Paragraph 2, if the "Mall" has not informed the user in advance about the restrictions on withdrawal of subscription or has not provided a trial product, the user's withdrawal of subscription shall not be restricted.
4. Notwithstanding Paragraphs 1 and 2, if the content of the goods or services differs from what was advertised or provided in the contract, the user may withdraw their subscription within three months from the date the goods were supplied or within 30 days from the date they discovered or could have discovered the discrepancy.
Article 17 (Effects of Withdrawal of Subscription, etc.)
1. Upon receiving the returned goods or services from the user, the "Mall" shall refund the payment within three business days. If the "Mall" delays the refund, it shall pay delay interest for the period of delay at the rate determined and announced by the Fair Trade Commission.
2. When the user has paid for goods or services using a credit card or electronic payment method, the "Mall" shall immediately request the relevant provider to stop or cancel the payment.
3. The costs associated with returning the goods due to withdrawal of subscription shall be borne by the user. The "Mall" shall not claim penalties or damages from the user for the withdrawal of subscription. However, if the withdrawal is due to discrepancies in the content of the goods or services as advertised or agreed, the "Mall" shall bear the return costs.
4. If the user bore the shipping costs when receiving the goods, the "Mall" must clearly indicate who will bear the costs in the event of withdrawal of subscription.
Article 18 (Protection of Personal Information)
1. The "Mall" collects only the minimum information necessary to fulfill the purchase contract. The following items are mandatory, and other items are optional:
① Name
② Address
③ Phone number
④ Desired ID (for members)
⑤ Password (for members)
⑥ Email address (or mobile phone number)
2. When collecting personally identifiable information, the "Mall" must obtain the user's consent.
3. The provided personal information shall not be used for purposes other than the intended purpose or disclosed to third parties without the user's consent. However, the following cases are exceptions:
① When the minimum information necessary for delivery is provided to the delivery company.
② When used in a form that does not identify individuals for statistical, academic, or market research purposes.
③ When necessary for payment settlement in transactions of goods or services.
④ When required for identity verification to prevent misuse.
⑤ When required by law or unavoidable circumstances.
4. If the "Mall" requires consent under Paragraphs 2 and 3, it must notify or disclose in advance the identity of the personal information protection officer (name, affiliation, phone number, and other contact information), the purpose of collection and use, and details of information provided to third parties (recipients, purpose, and contents). Users may withdraw their consent at any time.
5. Users may request to view or correct errors in their personal information at any time, and the "Mall" shall promptly take necessary measures. During this process, the "Mall" shall not use the concerned personal information until the errors are corrected.
6. The "Mall" limits the number of personal information managers to the minimum required and takes full responsibility for any loss, theft, leakage, or tampering of personal information, including credit cards and bank accounts.
7. The "Mall" or third parties provided with personal information shall destroy such information immediately once the purpose of collection or provision has been achieved.
Article 19 (Obligations of the "Mall")
1. The "Mall" shall not engage in any acts prohibited by law or contrary to public order and morals and shall strive to continuously and reliably provide goods and services as stipulated in this agreement.
2. The "Mall" shall have a security system in place to protect users' personal information (including credit information) so that they can safely use internet services.
3. If the "Mall" causes damage to users by engaging in unfair labeling or advertising as defined by the Act on Fair Labeling and Advertising, it shall be liable for compensation.
4. The "Mall" shall not send unsolicited commercial emails to users for profit.
Article 20 (User’s ID and Password Responsibilities)
1. Except as specified in Article 17, the user is responsible for managing their ID and password.
2. Users shall not allow third parties to use their ID and password.
3. If a user becomes aware of theft or unauthorized use of their ID and password by a third party, they must immediately notify the "Mall" and follow the "Mall's" instructions.
Article 21 (User Obligations)
Users shall not engage in the following actions:
1. Providing false information during registration or updates.
2. Misusing another person's information.
3. Modifying information posted by the "Mall."
4. Sending or posting information (e.g., computer programs) other than what the "Mall" specifies.
5. Infringing on the intellectual property rights of the "Mall" or third parties.
6. Damaging the reputation of or disrupting the operations of the "Mall" or third parties.
7. Posting or disclosing obscene or violent messages, images, audio, or other content contrary to public order and morals on the "Mall."
Article 22 (Relationship Between Linked "Mall" and Subordinate "Mall")
1. If a superior "Mall" and a subordinate "Mall" are connected via a hyperlink (e.g., text, images, or videos), the former is referred to as the "Linked Mall," and the latter is referred to as the "Subordinate Mall."
2. The "Linked Mall" is not liable for transactions made independently by the "Subordinate Mall" unless it explicitly states otherwise on its initial screen or pop-up at the connection point.
Article 23 (Copyright and Use Restrictions)
1. Copyright and intellectual property rights for works created by the "Mall" belong to the "Mall."
2. Users may not use information with intellectual property rights belonging to the "Mall" for commercial purposes or allow third parties to do so without prior consent from the "Mall."
3. If the "Mall" uses intellectual property rights belonging to users under agreement, it must notify the user in advance.
Article 24 (Dispute Resolution)
1. The "Mall" shall establish and operate a grievance handling body to reflect users' legitimate opinions or complaints and compensate for any damages.
2. The "Mall" shall prioritize processing complaints and opinions submitted by users. If immediate processing is difficult, the "Mall" shall promptly notify the user of the reason and schedule for resolution.
3. If disputes arise between the "Mall" and users in relation to e-commerce, users may follow the arbitration of dispute resolution institutions designated by the Fair Trade Commission or local government.
Article 25 (Jurisdiction and Governing Law)
1. Litigation related to e-commerce disputes between the "Mall" and users shall be under the jurisdiction of the court having authority over the user's address at the time of filing. If the user's address is unknown or they reside abroad, the case shall be filed with the competent court under the Civil Procedure Act.
2. Lawsuits between the "Mall" and users shall be governed by the laws of the Republic of Korea.
